Knowing What To Offer On A Foreclosure

A bank-owned foreclosure can be a great deal sometimes because the bank owns it and is paying for the maintenance of it. As opposed to a property offered as a short sale, the selling bank has a big motivation to get the listing off of their books. At the same time, banks who are involved in selling a foreclosure want to maximize the amount they get out of the property. In the lower price ranges it has turned into a sellers market meaning that many foreclosures sell for well above the listing price! Knowing what to offer for the foreclosure is critical in terms of being successful with your purchase.

One thing you should know is that bank-owned properties will almost always limit how much they will pay towards the buyer’s closing costs. If you buy a traditional sale we can usually negotiate for the seller to pay all of your costs. With either a foreclosure or a short sale however you will generally need to cover some of the costs on your own. If you qualify for a Minnesota down payment assistance programs this can be used to offset some of the remaining closing costs on bank owned properties.

What do I need to know about buying

bank-owned or pre-foreclosed property

in the Twin Cities?

  • Often, distressed properties in the Twin Cities Area are in excellent condition and in very desirable locations. Homeowners in every price bracket areaffected by the economy.
  • Bidding wars happen in some Twin Cities Housing Markets, but they mainly occur in the most distressed ones. As in any market, the most competitive offers are most likely to win.
  • The key to streamlining the loan process and avoiding surprises is to work with an experienced real estate agent and a lenderwho regularly handles distressed property transactions.
  • The timeline for short sale transactions is tightening and REO transactions tend to occur within a faster time frame than the traditional home-buying process.
  • Foreclosures are happening in record numbers and sellers are very motivated.

Distressed properties fall into two broad categories:

  1. Short sales or “pre-foreclosures,” where agents negotiate with banks to accept a sales price and loan payoff that is less than the mortgage amount. Short sales occur in instances where home sellers are “underwater” on their mortgage, which means that the amount of their current mortgage exceeds the market value of the home.
  2. Foreclosures or REOs (real estate owned), which have become the property of the bank due to the homeowner failing to pay the mortgage for several consecutive months.

The Macalester-Groveland neighborhood with lovely tree-lined streets and single family homes. Many of the houses have historical and architectural interest and were built pre-1940. Foreclosures are Bank-Owned

A foreclosure can be a great value because the bank owns it and is paying for all of the upkeep and property taxes. At the same time, banks who are selling a foreclosure want to maximize the amount they get out of the property. In the lower price ranges it has turned into a sellers market meaning that many foreclosures sell for well above the listing price! Knowing what to offer for the foreclosure is critical in terms of being successful with your purchase.

Things to Consider in Buying Foreclosures

There are 2 major factors to consider when determining how much to offer. The first is how long the property has been on the market and the second thing is to analyze the overall condition of the home. A foreclosure that has just been listed is likely to sell for near the listing price, while a bank that has a home that has been on the market a long time may be willing to negotiate for deep discounts. Also, a listing that is in poor overall condition may not be able to be financed with traditional mortgage financing so the bank may have to reduce the price far enough to attract cash buyers. I can help you work through these factors as we search for Mac-Groveland foreclosures.

Financing Your Foreclosure

If you are planning on financing the purchase of a foreclosure there are some critcal things to know. First, the property must be in acceptable condition in order to qualify for most loan programs. Properties in generally poor condition will either require a cash offer or special mortgage financing such as the FHA 203k program. The selling banks will also usually limit the amount seller paid concessions towards the closing costs of your home loan. In most cases the selling bank will limit their contribution to three per cent of the selling price. Finally a selling bank will never look at your offer if it includes a financing contingency and if you don’t provide a preapproval letter along with the offer.

For many MN first time home buyers the big question is where do I start? Your very first step towards buying your first home is to get preapproved for a first time buyer’s mortgage. By doing so you find out how much of a loan you are qualified for so that we can research homes in a comfortable price range.

Anyone that has been involved in a Short Sale know that they are anything but Short…Endless calls to the bank, appeasing the buyers and their agents, keeping the sellers informed and motivated to complete the sale. The list goes on. There are a few key elements that need to be known and can greatly effect the outcome. Here are the first 4 questions we will ask any would be Short Sale Seller:

1.  How far behind on payments are you, if any? From our experience, Mortgage companies look at a current loan as a “performing asset” which makes complete sense.  Why would they want to take less on a balance owed if they are getting paid every month?  If the seller is behind on payments, that’s another story – typically the file will be transferred to the collection department to try to recoup losses.  From our experience, it seems as though the collection department and loss mitigation do not talk to each other – almost like separate entities.  The reason why the time line is important is that we need to know how much time we will have to sell the property.  Usually within 3-6 months of missed payments the mortgage company will begin the formal foreclosure process.
2.  How many mortgage(s) do you have and with who? The more mortgages, the more headaches.  Think of it this way, if there is a 2nd mortgage on the property – the amount of work, phone calls, time has just doubled because you are now seeking approval from 2 mortgage companies, not just one.  The mortgage companies will not talk to each other (and sometimes not even if they are within the same company).  If the 2nd is a large enough balance in some cases and if the sale of the home is high enough, the 1st mortgage may not be effected.  I have only seen that happen once in the past 3-4 years.
3.  What are the balances owed on the mortgage(s)? Determining the value of the home vs. what is owed is crucial.  If the home is only worth $100,000 and there is $225,000 owed, that may be a challenge.  The good news now is that more and more mortgage companies are basing their approvals on market value not what is owed.  The mortgage compaies determine market value by having a 3rd party agent conduct  Broker’s Price Opinion (BPO).  The mortgage company does not trust us and they want to have their eyes and ears in the field so to speak.
4.  Have you received notification of a Sheriff Sale? The Sheriff Sale is a trigger point for MN Short Sales.  Once the Sheriff Sale takes place (the property is sold to the highest bidder – which 99% is the mortgage company protecting their asset), we have 6 months to either redeem the property or sell the property.  This is our clock and we have a definitive drop dead date.  If we are unable get the property sold at that time it will turn into a Foreclosure and go back to the mortgage company.

Short Sales can turn out to be some of the BEST deals for buyers in the market and also benefit the seller as well.  The time and energy invested in to a short sale is a ton, but the reward of closing one is AWESOME!  If you know of anyone that is in need of some guidance or counseling with a short sale property – I would love to help.  Email or call anytime.

How do you know when you can get a great deal on buying a home in the Twin Cities?  It all depends on your definition of what a great deal is.  Here are a few numbers released by the Minneapolis Association of Realtors (MAAR) for the Month of April.

  • PENDING Sales are DOWN 25.8% from April 2010 to April 2011 (expected without Tax Credit).
  • INVENTORY is DOWN 16.1% from April 2010 to April 2011 (expected without Tax Credit)
  • MEDIAN SALE PRICES are DOWN 14.6% from April 2010 to April 2011 (expected without Tax Credit).
  • Sellers are getting 90.1% of Original List Price in April 2011, which is DOWN 3.7% from April 2010.

Based on the numbers released by MAAR all signs point to yes you can find a great deal.  Inventory being down means less to choose from but median price down means better prices from just a year ago.  Negotiations are favoring buyers to the tune of about 10% off.  That means on a $200,000 house, offers are being accepted at roughly $180,000.

As in any Real Estate Market, Motivation is key.  Finding great deals often is a result of finding motivated sellers.  Bank owned, Estate and Short Sale properties can offer some of the highest motivated transactions in the market place.  Having the right agent help you find great deals is also key.

The MN economy is on the incline, but what about the MN housing market? In the Star Tribune on Sunday May 8th, 2011 – Jim Buchta wrote an article about this very predicament. In Jim’s article, he begins to deliberate over several factors that are contributing to this:

Uneven Gains: Economic growth is not universal. Not all areas in MN have experience the same amount of job growth and/or increase in wages. According to Jim, “Wright and Isanti Counties, were among the 10 fastest growing in the nation during the early part of the decade as big home builders tried to satisfy what they thought would be a strong demand throughout the decade. Instead, population growth in those communities came to a near standstill, development stopped and now there’s little in the way of new jobs to attract new residents.

Previously Protected: A few years back prior to the housing market crash, consumer confidence was at an all time high.  Despite the large equity gains we were seeing on an annual basis, buyers were still buying.  Lending guidelines were very loose and any that could “fog a mirror” could basically purchase a home.  No one expected home prices to drop so much.

Foreclosure Havoc: Many of the “fog a mirror” homes financed prior to the housing crash are now foreclosures.  According to the Minneapolis Association of Realtors, 3 out of 5 homes sold in February 2011 were either bank owned or short sales.  In March, the number was half.  According to the article, the national average for foreclosure/short sales is 40% and in March the Twin Cities was at 50% (March are the most recent numbers).

Is this the Bottom: No one really knows for sure.  A chief economist for Wells Fargo prices will likely remain stagnant at least through next year, the market could be in the midst of an over correction.  Another company based out of NC (Local Market Monitor), said that prices in the Twin Cities have already hit bottom.

In the past 2 weeks, we have seen multiple offers come in on one listing and have had 2 agents on our team win multiple offers for buyers.  This could be an isolated incident, but with that type of activity and the Spring Market just blooming after a slow thaw – we cannot help but hope that we are on our way out.

Just because a property is labeled as a Foreclosure/Bank Owned or Short Sale – Does that mean it is the BEST home for sale in the Twin Cities? Based on the most recent numbers released (March) by the Minneapolis Area Association of Realtors we can use some factual data to help answer that question.

First – New Homes for Sale in Twin Cities in March:


Based on MAAR’s report there were 1,562 new Lender-Owned homes entering the market place in March 2011 (10% down from March 2010). On the flip side, you can see a huge decrease in new Traditional homes for sale in March 2011 – Down 36.8% from 2010 (largely due to the $8,000 buyer tax credit).

Second – Pending Homes for Sale in Twin Cities in March:

In March 2011, Pending Sales went up 30.7% from March 2010 for Lender-Owned Homes for Sale. From the Traditional Seller side, Pending Home Sales went down 30.6% from March 2010. Less homes entering the market as Lender-Owned. Traditional Sales only made up 427 more sales than Lender-Owned.

Third – Closed Homes for Sale in Twin Cities in March:

In March 2011, Lender-Owned Sales in the Twin Cities saw another increase in Closed Sales. There was a 30.9% increase in Closed Sales in March 2011 from March 2010. Traditional Sales fell back yet again with a 26.7% decrease from March 2010 to March 2011.

Fourth – Inventory of Homes for Sale in Twin Cities in March:

The amount of Lender-Owned homes for sale has increased (58.3%) in March 2011 from March 2010, which could attribute to the increase in Pending and Closed homes in March 2011. Traditional sales dropped 13.2% in March 2011 from March 2010.

Lender-Owned Homes for Sale and Short Sales make up roughly a 3rd of the market place. Paying close attention to the trends and ratios is important for both buyer and seller as they can have a great impact on how much you spend or net.
